Form of agreement
When a parent is being deployed for military service, both parents can make a temporary written agreement about who will take care of their child. Both parents must sign it, and if another person (not a parent) is also getting care of the child, that person must sign too. The agreement should cover things like where the deployed parent is going, who watches the child, how the deployed parent stays in contact with the child, and when the agreement ends. If some of those details are left out, the agreement is still valid.
452.1214. Form of agreement. — 1. The parents of a child may enter into a temporary agreement under sections 452.1214 to 452.1222 ing during .
2. An agreement under 1 of this section must be:
(1) In writing; and
(2) Signed by both parents and any to whom custodial responsibility is granted.
3. Subject to subsection 4 of this section, an agreement under subsection 1 of this section, if feasible, must:
(1) Identify the destination, duration, and conditions of the deployment that is the basis for the agreement;
(2) Specify the of among the , the other parent, and any nonparent;
(3) Specify any that accompanies a grant of caretaking authority;
(4) Specify any grant of to a nonparent;
(5) If under the agreement custodial responsibility is shared by the other parent and a nonparent, or by other nonparents, provide a to resolve any dispute that may arise;
(6) Specify the frequency, duration, and means, including , by which the deploying parent will have contact with the child, any role to be played by the other parent in the contact, and the allocation of any costs of contact;
(7) Specify the contact between the deploying parent and child during the time the deploying parent is on leave or is otherwise available;
(8) Acknowledge that any 's cannot be by the agreement, and that changing the terms of the obligation during deployment requires in the court;
(9) Provide that the agreement will terminate according to the procedures under sections 452.1246 to 452.1252 after the deploying parent returns from deployment; and
(10) If the agreement must be filed section 452.1222, specify which parent is required to file the agreement.
4. The of any of the items specified in subsection 3 of this section does not an agreement under this section.
