A witness in a civil court case does not have to show up if the court is more than 40 miles from where the witness lives — unless the witness is paid travel money and one day's pay at the time the witness is asked to come.
491.130. Fees to be , when. — A shall not be compelled to attend, as such, in a , at a greater distance than forty miles from his place of residence, unless his for traveling, in going to and returning from the place of trial, and one day's attendance, are paid or tendered to him at the time of such witness.
