Witness liable to action, when

If someone is called to be a witness in court and is paid the required travel money and one day's fee upfront, that witness must show up. If the witness does not show up and has no good reason, the person who called them can sue the witness for any harm caused by their absence.

491.140. to , when. — When a causing a witness to be , shall have paid or to such witness his for traveling, and one day's attendance, at the time of such witness, if he fail to attend he shall be liable to the action of the party for all by the , unless he show sufficient to justify such absence.
