Physician not liable for restraint of mentally incapacitated persons
A doctor, surgeon, or the owner of a private hospital or care facility cannot be sued for money if they restrain a mentally incapacitated person, as long as they were honestly trying to care for or treat that person at the time.
537.120. Physician not for of persons. — No regular practicing or or surgeon or the owner or of any private or hospital shall be for restraint of any mentally incapacitated person by reason of having furnished care, treatment or attention to such person, and while such person is under the care of such physician or surgeon or confined in such sanatorium or hospital.
