When a parent gets notice they are being deployed for military service, either parent can ask a court to temporarily change who takes care of the child during that time. The court can approve a temporary arrangement, but cannot make it permanent without the deployed parent agreeing. Either parent can file paperwork asking for this change, either in an existing court case or by starting a new one.
452.1226. for . — 1. After a receives notice of and until the deployment terminates, a court may a granting unless prohibited by the , 50 U.S.C. Appendix Sections 521 and 522. A court may not issue a permanent granting custodial responsibility without the of the deploying parent.
2. At any time after a deploying parent receives notice of deployment, either parent may file a regarding custodial responsibility of a child during deployment.
