Nature of authority created by agreement
When a deployed parent makes an agreement giving someone else temporary care of their child, that agreement is only short-term. It ends after the parent comes back from deployment, or sooner if a court cancels it. The agreement does not give the other person any permanent rights to the child. However, the person caring for the child can go to court to enforce the agreement while it is still active.
452.1216. Nature of created by agreement. — 1. An agreement under sections 452.1214 to 452.1222 is temporary and terminates sections 452.1246 to 452.1252 after the returns from , unless the agreement has been terminated before that time by or under section 452.1218. The agreement does not create an , continuing right to , , or in an individual to whom is given.
2. A who has caretaking authority, decision-making authority, or limited contact by an agreement under sections 452.1214 to 452.1222 has to the agreement until it has been terminated by court order, by modification under section 452.1218, or under sections 452.1246 to 452.1252.
