Report of sale

When someone in charge of a dead person's estate sells, mortgages, or leases real estate, they have to file a report about it within 10 days. That report has to sit on file for 10 days before the court looks at it. Anyone with an interest in the estate can file written objections. The court then checks if the deal was the best one possible and followed the law — if so, the court approves it and orders the proper paperwork to be completed.

473.513. Report of sale — objections — approval. — 1. Within ten days after making a sale, or of , the or shall make a full report of his proceedings, with the if a new is required by the court, and a copy of the , if a public sale, which report shall be that he did not, directly or indirectly, purchase the real estate or any part thereof, or any interest therein, and that he is not interested in the property sold except as stated in the report. 2. A person interested in the desiring to object to may file objections in writing, setting forth the reasons therefor.

3. The court shall examine the report and if satisfied that the sale, mortgage or lease has been at the price and terms most advantageous to the estate and in all respects made in conformity with law and ought to be confirmed, shall approve the same and the executor or administrator to make a , mortgage, lease or other proper instruments to the person entitled .
