Execution of conveyance or lease where personal representative resigns, dies or has letter revoked

When someone is in charge of a deceased person's estate (called a personal representative) and they sell, trade, mortgage, or lease property but then quit, die, or get removed before signing the paperwork, the buyer or lessee can ask the court to fix it. If the court is satisfied the money was paid, it orders whoever is now in charge of the estate — or the county sheriff if the estate is already closed — to sign the documents instead. Those signed documents count the same as if the original person had signed them.

473.523. of or where resigns, dies or has letter . — When a personal representative resigns or dies, or his are revoked after the sale, exchange, or lease of , and before executing a conveyance or lease therefor, the purchaser, , or , his , or grantees may the court, stating the facts. If he satisfies the court that the was paid, the court shall the personal representative then acting, or, if after , the sheriff of the county to execute and acknowledge to the purchaser, mortgagee or lessee, his heirs, assigns or grantees an conveyance or lease, referring to the petition and , with such other as provided by section 473.520. Such conveyance or lease shall be accordingly and has the same effect to all intents and purposes as if made by the personal representative who made the sale, exchange, mortgage or lease of the real estate.
